POOLS

149-1. Permit required for certain pools; fees; plans.

Any person or persons desiring to construct a bathing,
swimming place or swimming pool, or artificial body
of water, or any excavation in which water may collect
in excess of a depth of two feet, within 300 feet of
any property line of the property on which it is to
be located, shall first secure a permit from the Building
Inspector of Abington Township. The fee for swimming
pools shall be $10 per 100 square feet or fraction thereof
for all aboveground pools and $25 plus $10 per $1,000
or fraction thereof of contract price for all in-ground
pools. The applicant shall submit to the Building Inspector
such plans, drawings or other data required by the Building
Inspector as shall satisfactorily indicate the method
of fencing and latching and the manner of the emptying
of the pool.
149-2. Fencing required for certain pools; gates. [Amended
11-13-1958 by Ord. No. 920]
A. Every bathing, swimming place or swimming pool not
enclosed in a building, or any artificial body of water,
or any excavation in which water may collect in excess
of a depth of two feet, heretofore or hereafter installed
or constructed within 300 feet of any property line
of the property on which it is located, shall be entirely
surrounded by a substantial wire mesh or solid fence
not less than four feet in height which contains no
vertical interspace of more than two inches and no horizontal
rail or component on the outside usable as a footstep
and which satisfies the appropriate following minimum
requirements:
(1) Wood picket, three-fourths-inch stock.
(2) Iron picket, one-half-inch iron bar.
(3) Chain link, vertical chains to be No. 9-gauge wire
and a maximum of two inches apart.
(4) Woven or other solid fence, of strength equivalent
to one of the foregoing, satisfactory to the Building
Inspector.
B. Each gate in every such fence shall be secured with
a lock satisfactory to the Building Inspector.
149-3. Violations and penalties.
Any person failing to comply with the terms of this
chapter shall be subject to a fine not exceeding $100
and costs and, in default of payment thereof, to imprisonment
in the county prison for a term not exceeding five days.
